The federal government is funding a sea change in health care by investing in interventions targeting social determinants of health, which are significant contributors to illness and health inequity. This funding power has encouraged states, professional and accreditation organizations, health care entities, and providers to focus heavily on social determinants. We examine how this shift in focus affects clinical practice in the fields of oncology and emergency medicine, and highlight potential areas of reform.

Susan Feagin’s book offers a welcome redirection in the philosophical understanding of fictional literature as an art. In recent decades the appreciation of literature has been reduced by many theorists and critics to considering what literary works reveal about either the societies in which they were produced, moral life in general, or conflicts in class, race, and gender. On a more abstract plane, questions about the logic of interpretation have preoccupied many philosophical analysts.

Most people have a sense of obligation to family members that is more powerful than the law in compelling compliance with its demands. When families dissolve, however, the power of such nonlegal norms often dissolves as well. The question then becomes what the law should require in their stead. This Article is part of a larger series of studies that have examined this question by asking what citizens believe the law should demand, using surveys of persons called to jury service (...) in Tucson, Arizona. Respondents are asked to imagine they are the judge charged with deciding a series of cases in which the facts are systematically varied so as to reveal the implicit principles that survey respondents employ in deciding them. Previously reported results in this project have examined studies of the amount of child support that people believe appropriate, and how they believe child custody disputes should be resolved. This study examines lay views about alimony. It finds considerable divergence between American law in practice and the views of American citizens as to what the law should be. Survey respondents were willing to award alimony considerably more often than the law now does. More clearly, in deciding whether to allow an alimony award, they care most of all about the claimant’s responsibility as primary caretaker of the couple’s minor children, to some extent about the partners’ marital status and their relational duration, and very little at all about the claimant’s history of having cared for the couple’s now-grown children. Moreover, the way these factors affect our respondents’ judgments about alimony are not very dependent on who they are. Our respondents did vary among themselves, of course, in the frequency with which they allowed alimony, but they varied relatively little in how factors such as marriage, relational duration, the presence of minor children or the history of care for now-grown children affected their judgments. The citizen consensus reflected by these patterns differs, however, from the prevailing legal rules, the views of many scholars, and the recommendations of the American Law Institute. This striking discrepancy is interesting although not always surprising. Our respondents’ willingness to award alimony to non-marital partners, for example, is consistent with the law of some other Western countries, even if not with American law, suggesting perhaps that it is American law, not our respondents, that is peculiar. Perhaps it is also understandable that our respondents seem more concerned with the welfare of the couple’s current minor children than with addressing perceived inequities in the current economic circumstances of the adult partners. In any event, the views of our respondents pose a challenge to policymakers. Given the dearth of theoretical justification for current American practice, its rejection by American citizens seems all the more telling. (shrink)

On the philosophy of some Hindu saints from Tamil Nadu.

Background In May 2020, England moved to an opt-out organ donation system, meaning adults are presumed to be an organ donor unless within an excluded group or have opted-out. This change aims to improve organ donation rates following brain or circulatory death. Healthcare staff in the UK are supportive of organ donation, however, both healthcare staff and the public have raised concerns and ethical issues regarding the change. The #options survey was completed by NHS organisations with the aim of understanding (...) awareness and support of the change. This paper analyses the free-text responses from the survey. Methods The #options survey was registered as a National Institute of Health Research (NIHR) portfolio trial [IRAS 275992] 14 February 2020, and was completed between July and December 2020 across NHS organisations in the North-East and North Cumbria, and North Thames. The survey contained 16 questions of which three were free-text, covering reasons against, additional information required and family discussions. The responses to these questions were thematically analysed. Results The #options survey received 5789 responses from NHS staff with 1404 individuals leaving 1657 free-text responses for analysis. The family discussion question elicited the largest number of responses (66%), followed by those against the legislation (19%), and those requiring more information (15%). Analysis revealed six main themes with 22 sub-themes. Conclusions The overall #options survey indicated NHS staff are supportive of the legislative change. Analysis of the free-text responses indicates that the views of the NHS staff who are against the change reflect the reasons, misconceptions, and misunderstandings of the public. Additional concerns included the rationale for the change, informed decision making, easy access to information and information regarding organ donation processes. Educational materials and interventions need to be developed for NHS staff to address the concepts of autonomy and consent, organ donation processes, and promote family conversations. Wider public awareness campaigns should continue to promote the positives and refute the negatives thus reducing misconceptions and misunderstandings. Abstract Energy typically is discussed in terms of science, technology, economics, and politics. Little attention has been given to fundamental religious and ethical questions surrounding the upcoming transition to renewable energy. The essays in this thematic section seek to redress that deficiency. This introductory essay raises some key questions and summarizes various presentations on energy and religion, as these were held at the 2010 conference of the Institute on Religion in an Age of Science (IRAS). Some presentations described the energy (...) landscape and provided data and perspectives needed for sound policy. Others raised ethical and religious considerations for energy decisions as the transition from nonrenewable to renewable sources is faced. Some posed the challenges of the energy transition to religion itself. Yet others offered examples of sustainable energy use and/or promising sources for meeting future needs sustainably. At the conclusion of the conference, presenters crafted a common “Statement on Energy and Climate Change” that includes a “Call to Action.” The “Energy Statement” follows as an appendix. (shrink)

Les politiques technologiques visant à mettre en relation les acteurs scientifiques et économiques se sont profondément transformées entre 1962 et 1988. Aux politiques technologiques prenant la forme de « grands programmes technologiques » succèdent des politiques dites « de soutien à l’innovation » caractérisées notamment par des dispositifs de soutien à l’investissement destinés aux entreprises ou la mise en œuvre de réseaux visant à accroître les synergies entre les mondes scientifiques et industriels. Seneca’s philosophy dedicates a special attention to passions, regarded as the main obstacle to attaining wisdom, and in particular to anger, considered the most dreadful of them all. Scholars have usually interpreted his treaty On anger as a private handbook of ethics containing advice about how to become wise. However, this article explores a different approach to the text, placing it in the context of Seneca’s discussion about the virtue of courage. Although Dirār b. ʿAmr is the most important mutakallim of the second century, he is unfortunately one of the unjustified names in the history of kalām. Dirâr is a mutakallim whose name is rarely mentioned in theological publications published in both Turkish and foreign languages until recently, and his importance and position are still not noticed. As a matter of fact, Josef van Ess and W. Montgomery Watt, who are famous orientalists, discovered this tragic fact and tried to make up (...) for this deficiency to some extent with their studies. Dirâr wrote a refutation of Aristotle's theory of substance and accident, opened a new way with his understanding of existence based on accidents and led Ash'ari with the theory of kasb and Ebu'l-Huzayl al-‘Allaf with his kalām accumulation. Undoubtedly, one of the things that makes Dirār important is that he had views that went beyond his time and caused him to contradict his contemporaries as early as the second century in terms of the history of Islamic thought. Considering the list of works that have not survived, except for one, in such a period when the mainstream sects were not yet formed and they were on the eve of their formation, Dirār was generally in a critical dialogue with the Islamic and non-Islamic movements he encountered and knew. For this reason, it is almost impossible to place him in any religious sect mentioned in his period. Because he often preferred to follow his own ideas rather than the opinions of others on many issues. Naturally, this makes it difficult to place Dirār in a certain school and frees him from all kinds of bonds. Yes, in the sources we come across many allegations, accusations and slanders that Dirār is a Cahmi/Jabri, he is a Mu‘tazili, he is an innovator with malignant ideas, he is an infidel to put a bounty on his head. Understanding the reasons for these depends on getting to know Dirār, understanding his ideas, and determining his position. If we say in the context of our study, the position of Dirār is actually a state of non-position, and we think that the concept that best expresses this situation in a new interpretation is "nawābit". In the light of our analysis, we see that, with the exception of a name, nawābit is used as a concept with a negative content and connotation in both theology and philosophy. The exceptional person is the famous philosopher Ibn Bājja (Avempace) from Andalusia, the contemporary of Ibn Rushd (Averroes). While Mu‘tazili mutakallims use nawābit to humiliate groups such as Ahl-i hadith and Hashviyye, which adopt the narration-oriented line that puts reason and acumen to the second place, Al-Fārābī also uses the fault types and the sick characters in his virtuous city that he has constructed to describe. Ibn Bājja, on the other hand, considers the people called nawābit within his project to be equivalent to the "mutawahhid" (alone human) whose "precaution" he aims; this usage which corresponds with the context of the concept in the study. Nous n'en sommes pas (tout à fait) là, mais de nombreux centres de (...) recherche "transhumanistes" y travaillent partout dans le monde, avec des financements colossaux en provenance de géants du Web tel Google. Les progrès des technosciences sont d'une rapidité inimaginable, ils échappent encore à toute régulation. En parallèle, cette "infrastructure du monde" qu'est le Web a permis l'apparition d'une économie dite "collaborative", celle que symbolisent des applications comme Uber, Airbnb ou BlaBlaCar. Selon l'idéologue Jeremy Rifkin, elles annoncent la fin du capitalisme au profit d'un monde de gratuité et de souci de l'autre. N'est-ce pas, tout à l'inverse, vers un hyperlibéralisme, vénal et dérégulateur, que nous nous dirigeons? Certaines perspectives ouvertes par les innovations technoscientifiques sont enthousiasmantes, d'autres effrayantes. "L'ouvrage que nous propose aujourd'hui Mme Delphine Espagno est peut-être la plus belle des invitations qui ait été écrite afin d'inciter le lecteur, citoyen et/ou juriste, à comprendre la pensée du doyen de Bordeaux. Léon Duguit méritait effectivement le présent ouvrage et hommage car le doyen, comme Jean-Jacques Rousseau avant lui, a longtemps été et est encore souvent présenté soit comme un marginal de la pensée juridique, soit est même dédaigné de façon méprisante comme si sa qualité de juriste lui (...) était déniée. Hauriou, nous rappelle l'auteure, ira même ainsi jusqu'à affubler Duguit d'être un "anarchiste de la chaire" ce qui n'avait manifestement pas totalement déplu à ce dernier! Car, ce que rappelle Mme Espagno dès son introduction, c'est bien une nouvelle manière de penser et de réinventer le Droit dans son ensemble que nous invite à accomplir Léon Duguit. Il n'est pas qu'un faiseur de théorie(s) (comme celles du service public, des agents publics ou encore de l'Etat), il est - pour reprendre l'expression de Chenot désormais consacrée - un véritable "faiseur de système dans son sens le plus noble et mélioratif. Duguit assume en effet son rôle de guide et nous a donné à voir une nouvelle façon d'appréhender le Droit non pas tel qu'il est mais tel qu'il devrait être. Un Droit qu'il a comme réinventé en chaussant de nouvelles lunettes tel le spectateur qui verrait en deux dimensions et désormais en découvrirait - grâce à lui - une troisième. Après Léon Duguit, les juristes n'ont ainsi pu feindre de ne concevoir le Droit qu'à l'instar d'un artifice fictif, technique et juridique : le Droit est devenu indissociable de la sociologie. Ce "droit duguiste" nous offre alors grâce à la lumière qu'y dépose avec délicatesse Mme Delphine Espagno la vision renouvelée des relations existantes entre Droit, individu et collégialité ou société. En outre, ce que va construire le doyen de Bordeaux n'est pas - comme on le lit encore souvent - une "simple" théorie du service public mais une théorie réaliste de l'Etat par le service public", Mathieu Touzeil-Divina. A cet égard, l'ouvrage que Daniel Halévy consacra au philosophe du Gai Savoir, voici déjà un demi-siècle, reste un modèle du genre. Et, à l'heure où l'on célèbre le centenaire de la mort de Nietzsche, il s'ira pose comme un classique indispensable à la compréhension d'une œuvre trop souvent dénaturée par ses interprètes. L’article porte sur un mouchoir décoré par des femmes de l’Armée Républicaine Irlandaise (IRA) pendant leur incarcération à la prison d’Armagh, en 1976. Il s’intéresse aux aspects concrets d’un objet genré et politisé. En effet, le tracé, le remplissage à la couleur, la signature et l’échange de ce tissu prennent place à la fin de la première phase du conflit en Irlande du Nord caractérisée par les emprisonnements politiques. Dans les années 1970, les prisonniers républicains adaptent une activité féminine, la (...) broderie. Illustrant cette pratique, le mouchoir d’Armagh passe pour un exemple de tissu, certes hétérogène et marqué d’emprunts, mais qui conserve ses qualités liées au genre. L'A. mette costantemente a confronto le posizioni dei due filosofi evidenziando i tentativi di Egidio di staccarsi da Tommaso e criticarne (...) la dottrina, in particolare rispetto alla trattazione dell'ira. L’apôtre Paul a la réputation d’être un théologien performant dans l’argumentation, plus enclin à la rationalité qu’aux envols extatiques. Or, un examen attentif de sa correspondance fait apparaître la présence d’expériences religieuses, que l’apôtre raconte, et que l’on ne peut hésiter à appeler mystiques. Les signes sont discrets, mais indéniables: parler en langues, guérisons charismatiques, extases, visions. L’enquête de Daniel Marguerat fait l’inventaire de ces expériences, mettant en évidence l’interprétation qu’en donne l’apôtre. De Husserl à Henry, l’essence de la phénoménalité a changé de lieu, quittant le monde de la manifestation dans lequel l’être est à la fois caché et livré par des apparences, pour la pureté d’une auto-affection qui ne saurait s’y révéler comme telle, étant donné que son déploiement est purement immanent. Si la phénoménologie husserlienne ne peut, selon Michel Henry, que contribuer à « étendre le règne de l’apparence », la philosophie henryenne ira jusqu’à remettre en question le statut de (...) la phénoménalité à partir de la vie transcendantale incarnée. Le paraître se videra ainsi progressivement de la vie transcendantale dont il s’était fait l’expression sensible chez Husserl. En revenant de Henry à Husserl, nous essayons de montrer que si l’apparence est considérée comme la voix sensible de l’apparaître, ce dernier ne cesse pas pour autant de vivre. (shrink)
